Types of Powers of Attorney for Foreign Use
The most common powers of attorney for foreign use include:
- General power of attorney — for property management, court representation, opening bank accounts abroad
- Power of attorney for representation — at a specific authority or organization (embassy, court, registration body)
- Power of attorney for property disposal — sale/purchase of real estate, vehicles abroad
- Power of attorney for document collection — pension, inheritance, correspondence in another country
Each type has its own content and formatting requirements. Power of attorney translation must precisely convey the scope of authority — an error may result in refusal to act on the power of attorney.
Step 1. Notarizing the Power of Attorney
A power of attorney for foreign use is drafted and certified by a Russian notary. Notarial certification costs from 2,000 to 5,000 RUB depending on the type and scope.
Recommendation: before visiting the notary, check the requirements of the receiving party. Some authorities require specific details (case numbers, institution addresses). If the power of attorney is drafted imprecisely, it may be rejected even with a perfect translation.
Step 2. Apostille or Consular Legalization
Apostille on a notarial power of attorney is issued by the territorial office of the Ministry of Justice. Processing time — up to 30 business days. State fee — 2,500 RUB. Apostille is required for countries party to the Hague Convention (over 120 states).
For countries outside the convention (UAE, China, Canada, Saudi Arabia), consular legalization is required: Ministry of Justice → Ministry of Foreign Affairs → destination country consulate. The procedure takes 2 to 6 weeks.
Step 3. Translating the Power of Attorney
After receiving the apostille (or legalization), the power of attorney is translated into the destination country's language. The translation includes: the power of attorney text, notary's certification inscription, seals, stamps, and apostille text.
The translation is notarized — the translator signs the translation in the notary's presence. Power of attorney translation costs from 1,200 RUB; notarization from 1,200 RUB.
Country-Specific Requirements
Germany: translation into German, notarization mandatory. German authorities accept only powers of attorney formatted according to a specific structure — we know current requirements and provide consultation before processing.
Spain: translation into Spanish by a sworn translator (traductor jurado). We work with accredited translators recognized by the Spanish Ministry of Foreign Affairs.
Italy: translation into Italian + asseveration (asseverazione) — translator's oath at an Italian court. The procedure is performed through our partners in Italy.
Turkey: translation into Turkish of a notarized power of attorney. Apostille has been accepted since 2016 (Turkey joined the Hague Convention).
Power of Attorney Validity Abroad
The power of attorney's validity period is determined by Russian law and specified in the text. If no period is specified, the power of attorney is valid for 1 year (Article 186, Civil Code of the Russian Federation). For foreign use, we recommend specifying a concrete period — this eliminates questions from foreign authorities.
Note: some countries impose their own restrictions. For example, German banks may require a power of attorney issued no more than 6 months prior.
